U.S. Supreme Court rules to uphold Affordable Care Act in a 5-4 decision


Chief Justice John G. Roberts Jr. joined with Justices Ginsburg, Breyer, Sotomayor, and Kagan in the majority opinion, upholding the Affordable Care Act (ACA) individual mandate which will require individuals to purchase health insurance or face a tax beginning in 2014. The ruling would also allow states to opt out of the ACA’s Medicaid expansion provision without risking loss of all of their Medicaid funds. Justices Kennedy, Scalia, Thomas, and Alito dissented. Infection prevention regulations required by the ACA are not expected to be impacted by this ruling.
