APIC PolicyPro Terms and Conditions
APIC’s PolicyPro Policies (the “Policies”) were created by a group of contributors on behalf of the Association for Professionals in Infection Control and Epidemiology, Inc. (the “Association”). The Policies are among a suite of policies created with a goal of assisting covered facilities and establishments to demonstrate compliance with applicable prevailing standards for minimizing the spread of infection and disease. While the Association has undertaken to have the Policies reflect prevailing standards, the Association does not guarantee, represent, or warrant that the Policies will give the user (“User”) any advantage, benefit, or qualification. Further, the Policies were created as a sample to be used by and customized by each User to fit the User’s own individual requirements and needs. It is the sole responsibility of the User to tailor the Policies for its own use; the Policies are not intended to be used or implemented by the User without appropriate customization. The Policies are intended to be updated regularly and the Association welcomes input and suggestions for improvement. Users should be aware that developments and enhancements occur regularly and should not assume that all Policies’ content represents the current state of practice.
THE ASSOCIATION MAKES NO EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO THE INFORMATION CONTAINED WITHIN OR THE RESULTS CREATED BY THE POLICIES. ANY MENTION OF A SPECIFIC PRODUCT, COMPANY, OR ORGANIZATION IS NOT INTENDED AS AN ENDORSEMENT BY THE ASSOCIATION.
The User understands, acknowledges, and agrees that, in consideration for having access to the Policies, the User hereby releases, discharges, and holds harmless, individually and collectively, the Association and its affiliates, officers, directors, employees, committee members, members, subsidiaries, agents, contractors, successors, and assigns, from any and all liabilities that may arise, directly or indirectly, now or in the future, by reason of or in connection with any decision, action, or omission relating to the User’s use of the Policies.
The Association grants to the user a limited, revocable, non-exclusive, nontransferable, non-sublicenseable, personal license to download, customize, edit, and use the Policies and its related content (collectively, “Association Content”).
Notwithstanding the foregoing, the User may not translate, decompile, copy, distribute, disassemble, broadcast, transmit, publish, remove, or alter any proprietary notices or labels, license, sublicense, transfer, sell, mirror, frame, exploit, rent, lease, private label, grant a security interest in, or otherwise use in any manner not expressly permitted herein provided for the Association Content.
The use of any data or materials from the PolicyPro site, including use of the Information and any derivative works of the Information, for the training or development of any AI tools or services, or otherwise for any purposes relating to the use of AI or machine learning technology is strictly prohibited. APIC reserves the right to license out the use of the materials on its site, including the Information, for such purposes. APIC also prohibits scraping of any data or materials on the site for any purpose without APIC’s prior written consent.
By using the Policies, the User represents that they are at least eighteen (18) years of age (or the legal age of majority (whichever is greater)). In addition, the User agrees to abide by all applicable local, state, national, and international laws and regulations with respect to its use of the Policies.
These Terms and Conditions are intended to be and are in fact supplemental to and not in replacement of any addition terms and conditions imposed on users through, for example, accessing the Association website, becoming a member of the Association, or other participating in Association programs and activities. In the event these Terms and Conditions are in direct conflict with other applicable terms and conditions, the applicable provision in these Terms and Conditions shall control.
